Notice of Privacy Practices

Overview

This Notice of Privacy Practices describes how Cherry Creek Dental Spa may use and disclose your protected health information, how you can access this information, and the rights you have under HIPAA and other applicable privacy laws. This notice applies to Cherry Creek Dental Spa, its dental providers, team members, and service providers who help us with treatment, payment, health care operations, and practice administration.

Your Rights

When it comes to your health information, you have important rights. We will explain these rights and help you submit a request when needed.

• Get an electronic or paper copy of your dental record and other health information we maintain about you, subject to limited legal exceptions.
• Ask us to correct health information you believe is incorrect or incomplete. We may deny the request in certain cases, but we will explain why in writing.
• Ask us to contact you in a specific way, such as at a certain phone number, mailing address, or email address, when the request is reasonable.
• Ask us to limit what we use or share for treatment, payment, or health care operations. We are not always required to agree, but we will consider the request.
• Ask us not to share information with your health plan for a service you paid for in full out of pocket, unless a law requires us to share it.
• Receive a list, called an accounting, of certain times we have shared your health information.
• Receive a paper copy of this notice at any time, even if you agreed to receive it electronically.
• Choose someone to act for you if they have medical power of attorney or are your legal guardian.
• Receive notice if a breach occurs that may have compromised the privacy or security of your information.

Your Choices

For certain health information, you can tell us your preferences about what we share. If you are unable to tell us your preference, for example during an emergency, we may share information when we believe it is in your best interest.

• Tell us whether we may share information with family members, friends, caregivers, or others involved in your care or payment for your care.
• Tell us whether we may contact you for appointment reminders, follow-up care, treatment options, or practice communications.
• Tell us whether we may include your information in disaster relief efforts if that becomes relevant.
• We will not use or disclose your information for most marketing purposes, sell your health information, or share most highly protected records without your written authorization, unless allowed by law.
• If you give us written authorization, you may revoke it in writing at any time. We cannot take back disclosures already made with your authorization.

Treatment

We may use and share your health information to provide, coordinate, or manage your dental care.

• We may share information with dentists, hygienists, specialists, laboratories, imaging providers, pharmacies, physicians, or other professionals involved in your care.
• We may use your dental history, images, treatment plans, medications, health history, and notes to diagnose conditions, recommend care, and provide treatment.
• We may contact you about appointments, follow-up care, treatment alternatives, oral health reminders, or related services that may interest you.

Payment

We may use and share your health information to bill and collect payment for services.

• We may send information to dental benefit plans, health plans, claim processors, financing providers, or payment vendors.
• We may use information to verify coverage, submit claims, obtain pre-authorizations, coordinate benefits, and explain patient responsibility.
• We may share limited information with collection agencies or attorneys if needed to collect unpaid balances, as permitted by law.

Health Care Operations

We may use and share your health information to operate the practice and improve the care we provide.

• We may use information for quality review, training, credentialing, licensing, auditing, compliance, customer service, and business planning.
• We may use limited information to contact you about your experience, request feedback, or respond to questions or concerns.
• We may share information with business associates who perform services for us, such as secure hosting, billing support, email, phone systems, analytics, records management, IT support, or legal and accounting services. These vendors must protect your information.

Law, Safety, and Public Responsibilities

We may use or disclose your health information when the law allows or requires us to do so.

• To comply with federal, state, or local law, court orders, subpoenas, audits, investigations, or government requests.
• For public health, health oversight, disease reporting, product safety, abuse or neglect reporting, or workers compensation purposes.
• To prevent or lessen a serious threat to health or safety, or to help law enforcement when required or permitted by law.
• To coroners, medical examiners, funeral directors, organ donation organizations, military authorities, correctional institutions, or national security officials where applicable and legally permitted.

Special Protections

Some health information may receive additional protection under federal or state law. We will follow those additional protections when they apply.

• If we receive or maintain substance use disorder treatment records protected by 42 CFR Part 2, we will use and disclose those records only as permitted by applicable law.
• Information related to certain sensitive services, minors, communicable diseases, genetic information, or other specially protected categories may be subject to additional restrictions.
• Where Colorado law or another applicable law gives you greater privacy protection than HIPAA, we will follow the law that gives you greater protection.

Our Responsibilities

Cherry Creek Dental Spa is required by law to maintain the privacy and security of protected health information and to give you this notice of our legal duties and privacy practices.

• We will follow the terms of the notice currently in effect.
• We will let you know promptly if a breach occurs that may have compromised the privacy or security of your information.
• We will not use or share your information other than as described in this notice unless you tell us we can in writing.
• We will not retaliate against you for filing a complaint, asking a question, or exercising your privacy rights.

Questions and Complaints

If you believe your privacy rights have been violated, you may contact us directly or file a complaint with the U.S. Department of Health and Human Services Office for Civil Rights. Filing a complaint will not affect your care.

You can file a complaint with HHS OCR through the OCR Complaint Portal or by contacting the Office for Civil Rights. We will not retaliate against you for filing a complaint.

Changes to This Notice

We may change this notice and make the revised notice apply to health information we already have as well as information we receive in the future. The current notice will be posted on this website and available upon request.
